DMCA & Copyright Policy
Last updated: December 15, 2024
1. Introduction
TofuKit respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to copyright concerns in accordance with the Digital Millennium Copyright Act (DMCA).
2. Local Processing & Non-Hosting Declaration
TofuKit operates primarily as a LOCAL processing toolkit. Most of our tools process files entirely in your browser.
Our Service operates as follows:
- Local Tools (Metadata Cleaner, Mirror, Compress, MP3, GIF, Thumbnail, Volume): All processing happens in your browser using FFmpeg.wasm. Files NEVER leave your device or pass through our servers. We have no knowledge of or access to files you process.
- Video Downloader: We process URLs to identify direct video sources and redirect users to download from original platform servers (TikTok, Shopee, Instagram, Facebook, Threads, X/Twitter, Pinterest, Kwai, etc.)
- WhatsApp Link Generator: Creates links locally without any server communication
At no point does any video content pass through or reside on our servers. We function purely as a technical tool provider. For local processing tools, we have no ability to know, access, or control what files users process on their own devices.
3. Copyright Infringement Claims
Since most of our tools process files locally and we do not host any content, traditional DMCA takedown procedures have limited applicability to our Service. However, we take all copyright concerns seriously.
3.1 If You Are a Copyright Owner
If you have concerns about your copyrighted work, please understand:
- For Local Tools: We cannot access, view, or remove files processed locally on users' devices. Users are responsible for ensuring they have rights to files they process.
- For Video Downloads: Content is hosted by third-party platforms. File a DMCA takedown notice directly with the platform hosting your content (TikTok, Instagram, etc.)
- Once content is removed from the original platform, it will no longer be accessible through our download service
3.2 Platform-Specific DMCA Contacts
To report copyright infringement for downloadable content, please contact the hosting platform directly:
- TikTok: Report through the app or visit their Copyright Infringement page
- Instagram/Facebook/Threads: Use Meta's Intellectual Property reporting tools
- X (Twitter): Submit a DMCA report through their Help Center
- Pinterest: Use their Copyright complaint form
- Shopee: Contact their Intellectual Property Protection team
- Kwai: Report through their in-app reporting feature
4. URL Blocking Requests (Download Tool Only)
For the video download tool, we may, at our discretion, implement URL blocking for specific content upon receiving a valid request. To submit such a request, please provide:
- Identification of the copyrighted work you claim is being infringed
- The specific URL(s) you wish to be blocked from our processing system
- Your contact information (name, address, telephone number, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
- Your physical or electronic signature
5. Counter-Notification
If you believe a URL was wrongly blocked, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the material that was blocked and the URL where it appeared before blocking
- A statement under penalty of perjury that you have a good faith belief the material was blocked as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for your address (or if outside the US, any judicial district where we may be found)
- A statement that you will accept service of process from the party who submitted the original complaint
6. Repeat Infringer Policy
We reserve the right to terminate access to our Service for users who are determined to be repeat infringers. We may also implement measures to prevent the processing of URLs associated with repeatedly reported content.
7. User Responsibility
Users of TofuKit are solely responsible for ensuring they have the legal right to download, edit, and use any content they access or process through our tools. We strongly encourage users to:
- Only download or edit content they have created themselves or have explicit permission to use
- Obtain proper permission from content creators before reposting or modifying their work
- Use content only for personal, non-commercial purposes unless properly authorized
- Respect the intellectual property rights of others
- Comply with the terms of service of the original hosting platforms
8. No Legal Advice
This policy is provided for informational purposes only and does not constitute legal advice. If you have questions about copyright law or your rights, please consult a qualified attorney.
9. Contact Information
For copyright-related inquiries or to submit a URL blocking request for the download tool, please contact us through our website. Please include "DMCA/Copyright" in your subject line.
10. Policy Updates
We reserve the right to modify this policy at any time. Any changes will be posted on this page with an updated revision date.
